Update on Town Withdrawal from Dane County Zoning

Legislation approved in 2016 allows towns in Dane County, and only Dane County, to withdraw ("opt out") from coverage of the county zoning ordinance and other land use regulations. Six towns - Berry, Blue Mounds, Bristol, Springfield, Sun Prairie, Westport - have voted to officially withdraw from county zoning. These towns are now establishing their own system of zoning and land use administration, which will take effect on January 1, 2018.

Due to the time required to process various permit applications, Dane County will no longer accept the following land use permit applications for the six towns as of October 1, 2017:

  • Zoning map amendments (rezones)
  • Conditional Use Permits
  • Variances

Dane County will continue to issue zoning permits in the 6 towns through the end of 2017. Note that shoreland zoning permits are unaffected by this change, as the shoreland zoning regulations will continue to be administered by Dane County in the 6 towns.

All questions about future development proposals in the six towns listed above should be directed to the respective towns.

Comprehensive Revision of Dane County Zoning Ordinance

In February of 2016, the Dane County Board adopted 2016 Resolution 431, which created the Zoning and Land Regulations Comprehensive Revision of Chapter 10 Subcommittee, charged with overseeing the comprehensive revision of the Dane County Zoning Ordinance. This is the first time in the zoning ordinance's 78-year history that it has been comprehensively revised. More information on this project is available here.

Planning Grants - Better Urban Infill Development (BUILD)

The Dane County Better Urban Infill Development (BUILD) program provides grant funding to local municipalities to plan infill developments and promote livability and sustainability. BUILD grants help pay for planning consultants who assist communities with preparation of infill plans.

The Dane County Land Information Office and Planning and Development Department offer customized mapping services for municipal officials and other customers. This report assesses existing housing needs for each municipality in Dane County, and outlines strategies and tools for municipal officials, developers, and other partners as they consider how to address future housing needs.

New Shoreland Regulations

As of September 1, 2012 a Shoreland Zoning Permit will be required to be obtained prior to a general zoning permit being issued by the Dane County Zoning Division for any construction activities within 300 feet of a lake or stream.
